TERMS OF USE

These terms of use (“Terms of Use”) form the agreement between Acko General Insurance Limited (“Acko General”, “Company”, “us”, “we” or, “our”), as the operator of the website - https://www.acko.com/gi  (“Platform”) and you, as the visitor / user (“Visitor”, “Customer”, “User”, “you” or “your”), for access and/or use of the Platform or any product or services provided by us. 

THIS PLATFORM IS CREATED FOR INFORMATION PURPOSES IN THE INTEREST OF THE GENERAL PUBLIC. 

WHEN YOU AVAIL ANY OF THE SERVICES OR PRODUCTS OR POLICY PROVIDED BY US THROUGH THE PLATFORM (“SERVICE/S”), YOU WILL BE SUBJECT TO THE RULES, GUIDELINES, POLICIES, TERMS, AND CONDITIONS APPLICABLE TO SUCH SERVICE, AND THEY SHALL BE DEEMED TO BE INCORPORATED INTO THIS TERMS OF USE AND SHALL BE CONSIDERED AS PART AND PARCEL OF THIS TERMS OF USE. 

WE RESERVE THE RIGHT, AT OUR SOLE DISCRETION, TO CHANGE, MODIFY, ADD OR REMOVE PORTIONS OF THESE TERMS OF USE, AT ANY TIME WITHOUT ANY PRIOR WRITTEN NOTICE TO YOU. YOU SHALL ENSURE TO REVIEW THESE TERMS OF USE PERIODICALLY FOR UPDATES/CHANGES. YOUR CONTINUED USE OF THE PLATFORM FOLLOWING THE POSTING OF CHANGES WILL MEAN THAT YOU ACCEPT AND AGREE TO THE REVISIONS. 

AS LONG AS YOU COMPLY WITH THESE TERMS OF USE, WE GRANT YOU A PERSONAL, NON-EXCLUSIVE, NON-TRANSFERABLE, LIMITED PRIVILEGE TO USE THE PLATFORM. BY IMPLIEDLY OR EXPRESSLY ACCEPTING THESE TERMS OF USE, YOU ALSO ACCEPT AND AGREE TO BE BOUND BY OUR POLICIES INCLUDING BUT NOT LIMITED TO PRIVACY POLICY AS AMENDED FROM TIME TO TIME.

a. BY ACCEPTING THESE “TERMS OF USE”, YOU GIVE YOUR UNCONDITIONAL ELECTRONIC ACCEPTANCE TO THIS AGREEMENT UNDER THE INFORMATION TECHNOLOGY ACT 2000. 

b. This Platform will be deemed to be in use when it is loaded/ loading and/or continues to be loaded in a temporary or permanent memory of your computer, phone, tablet or any other similar device / system, or the internet browser thereof.

The User of this Platform unequivocally declares and agrees that the User is a natural / legal person who has attained the age of at least 18 years and is legally allowed to enter a contract in India. If you do not qualify, you may not use the Service or access the Platform.

a. You may be required to create an account on the Platform to avail or seek information on our Services / products or to utilize the full features of the Platform. You agree that if you create an account on the Platform, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under your account and any other actions taken in connection with it. 

b. You must immediately notify us of any unauthorized use of your account or any other breach of security within your knowledge. We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions. 

c. You agree that we may suspend, disable, or delete your account (or disable any feature or any part thereof) if we determine that you have violated any provision of these Terms of Use or that your conduct could, would or is likely to damage our reputation and/or goodwill and/or have a detrimental effect on our business or financial conditions, or lead to a violation of the provisions of any applicable law, in our sole and independent discretion. We may block your email address and Internet protocol address to prevent further registration / use / access.

d. You confirm and agree that you will maintain only one account on the Platform and will be the sole and exclusive owner of your account on the Platform, and accept sole responsibility for use, confidentiality and protection of your user ID and password. Additionally, you are prohibited from selling, trading, or otherwise transferring your accounts to another party. In the event your nominee requires access to your account upon occurrence of the events specified in the policy/ies, the nominee may write to us as per the details provided in the “Contact Us and Grievance” Section for transfer of your account, subject to due process of the Company and applicable laws, at the time of such request.

e. Subject to applicable laws, all transactions, which cannot be carried out instantaneously, shall be carried out during working hours either on the same day or on the next working day or such further period as may be determined and/or specified by Acko General depending upon the time of logging of the transaction subject always to the requirements under applicable laws. 

f. All transactions that are carried out shall be subject to notifications, the rules, regulations and guidelines issued by the IRDAI, the Reserve Bank of India (“RBI”), and those of other regulatory bodies defining rules/regulations governing the offer of any service and/or products on the Platform.

g. You agree to provide current, true, correct, latest and correct information and documents at any and all times, including for KYC purposes. The said KYC details and documents may be used by Us or our affiliates to perform KYC checks, verify you and extend the services to you, as further detailed herein and in the Privacy Policy. In the event of any changes to any personal information or KYC documents or any information in the KYC documents, you will promptly notify us via email and/or update the details under Your Account section immediately.

h. Providing false or incorrect information or details of any kind at the time of creation of your account or any time thereafter may result in the suspension or termination of your account and/or the policy/ies and/or refusal of claims (to the extent permitted under applicable laws). 

You understand, agree, and confirm that:

a. The availability of the information, data and guidance, if any, on the Platform does not constitute a recommendation (unless specifically indicated otherwise) and is not a solicitation (unless specifically indicated otherwise) by Acko General or any of their personnel or the experts used by Acko General whatsoever. 

b. Any decisions to purchase any policy/product/Service of Acko General must be based solely on the Visitor’s independent evaluation of the policies/products of Acko General, and their need for the same including personal and financial circumstances. 

c. The Visitor has the responsibility to determine whether the policies/products offered by Acko General satisfy the requirements and/or the needs of the Visitor. 

d. It is the responsibility of the Visitor to evaluate the completeness, accuracy or usefulness of any opinion, material or other content made available on the Platform, and you should consult your own legal counsel, business advisor, tax advisor and other financial advisors whomsoever concerned business, tax and related matters concerning any policy/ies with respect to which guidance is sought or given. 

e. The content and/or the Services on the Platform are not intended to provide any legal, tax or any financial related advice whatsoever. 

For any transaction which may be permitted by Acko General or undertaken on the Platform from time to time, Acko General’s records of such transactions maintained through computer systems or otherwise, shall be accepted as conclusive and binding for all purposes, and the decision of Acko General shall be final. You accept that the record of any transaction generated from the systems of Acko General shall be conclusive proof of the genuineness and accuracy of such transactions.

The premium estimate/s for motor insurance products is displayed on the assumption that all previous policies have been renewed continuously without any gap in insurance and no claim has been made in previous policies. The estimate/s for other insurance products is approximate and is not final and binding.

The final premium quotation for all products / Services may be viewed by clicking on the “Continue to Buy” tab. You may, at your sole and absolute discretion, decide not to proceed with the purchase of the policy/product/Service, in the event you do not agree with the final premium quoted on the Platform.

You agree that motor insurance products should only be purchased if you hold a valid Pollution Under Control (PUC) Certificate. 

a. In case pre-inspection of the vehicle is not completed due to any reason including unavailability of either parties (customer or representative of Acko General), customer will be eligible to receive refund of full amount paid towards insurance premium for such vehicle;

b. Policy will be issued subject to clearance of pre-inspection criteria at the satisfaction of the Acko General. Please be noted that Acko General shall not be liable for any risk which may arise before the policy commencement date. 

c. Acko General reserves a right to reject the proposal even after completion of the pre-inspection of the vehicle, however the customer will be eligible to receive the refund of the full amount paid towards the premium payment.

The User declares that the premium paid to Acko General Insurance Limited is being paid by You, i.e., the proposer/policyholder through a bank account or a Credit/Debit Card or a Prepaid Payment Instrument or a UPI wallet (Wallet), held by You in your name as a primary holder (referred to as “source account”). You further confirm that it is not a third-party payment made by any other person on your behalf. You also understand and agree that in the event of a policy cancellation, the refund of premium as per policy terms and conditions may be credited back to such source account and such electronic transfer will constitute full and final discharge of the Company’s obligation.

Acko General is a non-life insurance company and does not provide / promote any products or services other than non-life insurance products.

The various products/services/offers/discounts/coupons codes, if any, mentioned/displayed on Platform, which are not relating to insurance products of us, are offered/provided by the respective third-party service providers. In case multiple third-party service providers are providing products/services/offers/discounts/coupons codes, then You reserve a right to choose a service provider of Your choice for availing the wellness benefits / services.

Acko General does not represent, assure or endorse the accuracy, completeness, reliability or the quality of the products/services/offers/discounts/coupons codes, if any, of the third party service providers and shall not be in any way liable or responsible for any defects or deficiencies on the part of the third party service provider services.

a. You understand and acknowledge that Acko General and its affiliates own and/or hold all the rights for the information, contents, audio, video, logos and trademarks, including text, images, graphics, videos and sound contained in this Platform and/or the Services or any product on the Platform or otherwise (“Material”). 

b. You understand and agree that any reproduction, modification, creation of derivative works, distribution, transmission, copying, selling, displaying, publishing or using any of the information, contents, audio, video, logos and trademarks contained in this Platform or any Material or part thereof for any purpose whatsoever, whether electronically or otherwise, without the prior written permission of Acko General or its affiliates is strictly prohibited. 

c. You further understand and agree that any unauthorized use of the images displayed on the Platform may violate copyright laws, trademark laws, the laws of privacy and IRDAI or other advertising regulations and communications regulations and statutes, and you agree to not undertake any such unauthorized acts, and you shall be solely liable to the Company or any third party for any such illegal and unauthorized acts. Acko General will consider strict action in case of such violations, including appropriate legal action.

d. Acko General grants you a personal, non-exclusive, non-transferable, limited license to access the Platform and privilege to avail the Services and make personal use of the Platform and/or the Services. You may use and/or download material displayed on this Platform for your personal use only, provided that you also retain the logos, brand-names and markings pertaining to all trademark, copyright and other proprietary notices contained in the Materials. You agree not to use, transfer, distribute or dispose of any information contained on the Platform or the Material in any manner whatsoever. This limited license does not confer any right to download, copy, create a derivative work, modify, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sub-license, grant a security interest in or otherwise transfer any right in the Platform / Services. 

e. You do not have the right to remove, obscure, or alter any proprietary rights notices (including trademark and copyright notices), which may be affixed to or contained within the Platform / Services.

f. You are prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane material or any material that could constitute or encourage conduct (on the Platform or through your account or in the form of comments or otherwise) that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law. Acko General will fully cooperate with any law enforcement authorities or court order requesting or directing Acko General to disclose the identity of anyone posting any such information or materials.

g. You further acknowledge and affirm that you shall not:

ⅰ. Engage in fraudulent, abusive or illegal activity, including but not limited to any communication or solicitation designed or intended to fraudulently obtain the password or any private information of any use.

ⅱ. Copy (whether by printing off onto paper, storing on disk, downloading or in any other way), distribute (including distributing copies), download, display, perform, reproduce, distribute, modify, edit, alter, enhance, broadcast or tamper in any way or otherwise use any Materials contained in the Platform. These restrictions apply in relation to all or part of the Materials on the Platform.

ⅲ. Copy and distribute this information on any other server or modify or re-use text or graphics on this system or another system.

In consideration of Acko General providing the Platform / Services, you shall, at your own expense, indemnify and hold Acko General, its directors and employees, representatives, agents and/or the affiliates, as the case may be, indemnified against all losses and expenses on a full indemnity basis which Acko General, may incur, sustain, suffer or is likely to suffer in connection with Acko General, or affiliates' execution of the registered user's instructions and against all actions, claims, demands, proceedings, losses, damages, costs, charges and expenses as a consequence or by reason registered user's usage of Platform / Service for any action taken or omitted to be taken by Acko General, and /or the affiliates, its officers, employees or agents, on the instructions of the User. The User shall pay, on demand, to Acko General and /or the affiliates, such amount as may be determined by Acko General, and/or the affiliates to be sufficient to indemnify it against any such, loss or expenses even though they may not have arisen or are contingent in nature.

a) UNDER NO CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO NEGLIGENCE, MISCONDUCT OR DEFAULT, SHALL ACKO GENERAL, ITS AFFILIATES, ITS EMPLOYEES AND DIRECTORS, ITS SUPPLIERS AND/OR ITS THIRD PARTY ADVISORS BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING PUNITIVE OR EXEMPLARY (INCLUDING, BUT NOT LIMITED TO, DAMAGES CAUSED BY ANY VIRUS, PERSONAL INJURY, LOSS OF PROFITS, DATA OR OTHER INTANGIBLE, BUSINESS INTERRUPTION, LOSS OF PRIVACY, OR ANY OTHER PECUNIARY LOSS), ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE/DELIVERY/PERFORMANCE OF THIS PLATFORM  OR THE SERVICES, WITH THE DELAY OR INABILITY TO USE THIS PLATFORM OR ANY LINKS OR ITEMS ON THE PLATFORM, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THIS PLATFORM, OR OTHERWISE ARISING OUT OF THE USE OF THIS PLATFORM, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, OR RESULTING FROM THE USE OF THIS PLATFORM OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE PLATFORM /SERVICE OR RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

b) WHILE WE HAVE MADE REASONABLE EFFORTS TO INCLUDE ACCURATE AND UP-TO-DATE INFORMATION ON THIS PLATFORM, ERRORS OR OMISSIONS SOMETIMES OCCUR, THE PLATFORM, THE MATERIAL AND ANY CONTENT ON THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY ANY APPLICABLE LAWS, WE MAKE NO WARRANTIES OR REPRESENTATIONS AS TO THE CORRECTNESS, ACCURACY, COMPLETENESS, ADEQUACY, RELIABILITY, OR OTHERWISE OF THE CONTENT OF THIS PLATFORM, NOR DO WE ACCEPT ANY LIABILITY ARISING THEREFROM. WE DO NOT REPRESENT OR WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS OR BE UNINTERRUPTED OR ERROR FREE.

c) NOTHING IN OUR TERMS OF USE AND PRIVACY POLICY WILL PREVENT US FROM COMPLYING WITH THE APPLICABLE LAWS.

d) In no event shall our aggregate liability to you for all damages, losses and causes of action (whether in contract or tort, including but not limited to, negligence) exceed INR. 1000/-.

e) Policy/ies are marketed and/or distributed solely by Acko General as per the requirements of IRDAI and are not in any way associated to or being sold, marketed or offered for sale by the payment gateway service provider, and the payment gateway service provider shall not be liable for the same.

f) Acko General shall not be liable if any transaction does not fructify or may not be completed. We will not be held responsible for any delay or failure to comply with our obligations if the delay or failure arises from any cause/s which is beyond our reasonable control or not attributable to us.

g) We do not assume any responsibility, and are not liable for, any damages to, or viruses that may infect, your computer equipment or other property as a result of your access to, use of, or browsing in the Platform or your downloading of any materials, data, text, images, video, or audio from the Platform.

h) Please note that there is no guarantee that any email sent by you will be received, or that the contents of any such email will remain private during internet transmission and that there are inherent risks involved in sending the instructions/Communications/documents by electronic means and hereby agree and confirms that all respective risks shall be fully borne by you who assumes full responsibility for the same. In this regard, you will not hold the Acko General liable and hereby hold Acko General harmless from any demands, actions, liabilities, losses, damages, expenses or claims.

You warrant, represent and agree that you will not:

a) Participate in any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Platform or Acko General’s systems or networks, or any systems or networks connected to the Platform or to Acko General.

b) Use any device, software or routine to interfere or attempt to interfere with the proper working of the Platform or any transaction being conducted on the Platform, or with any other person’s use of the Platform.

c) Attempt to probe, scan or test the vulnerability of the Platform or any network connected to the Platform, nor to breach the security or authentication measures on the Platform or any network connected to the Platform.

d) Attempt to reverse look-up, trace or seek to trace any information on any other user of or visitor to the Platform, or any other customer of Acko General, including any Acko General account not owned by you, to its source, or exploit the Platform or any service or information made available or offered by or through the Platform, in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than your own information, as provided for by the Platform.

e) Use any “deep-link”, “page-scrape”, “robot”, “spider” or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Platform or any content, or in any way reproduce or circumvent the navigational structure or presentation of the Platform or any content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Platform.

f) Attempt to gain unauthorized access to any portion or feature of the Platform, or any other systems or networks connected to the Platform or to any Acko General server, or to any of the services offered on or through the Platform, by hacking, password “mining” or any other illegitimate means.

g) Attempt to forge headers or otherwise manipulate identifiers in order to disguise the origin of any message or transmittal you send to Acko General on or through the Platform or any service offered on or through the Platform. You may not pretend that you are, or that you represent, someone else, or impersonate any other individual or entity.

h) Attempt to use the Platform or any content for any purpose that is unlawful or prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity which infringes the rights of Acko General or others.

i) Attempt to knowingly or intentionally penetrate or access Acko General network or systems without authorization or exceeding authorized access; and by means of such conduct carry out an unauthorized transaction or obtain access to information, data or computer database that is restricted.

j) Attempt to introduce or cause to introduce any computer contaminant and by means of such conduct cause or be likely to cause damage or destruction to Acko General’s property or disruption of Acko General’s services.

k) The User shall pursue all necessary steps to ensure that their machines are virus free while accessing Acko General Platform. The User shall refrain from activities like uploading files infected with viruses or malicious scripts/ programs or trying to infect the Acko General system with viruses, worms & other malicious codes.

l) Unethical practices.

m) The User warrants that the User will not use any software, tool or code that would hamper or disable all or any portion of the Platform or Services offered by Acko General. The User also warrants against use of reverse engineering tools to break or harm the portals or services offered by Acko General. 

Although this Platform and/or the Services offered herein may be linked to other websites, we are not, directly or indirectly, implying any approval, association, sponsorship, endorsement, or affiliation with any linked website, unless specifically stated herein. We are not responsible for examining or evaluating, and we do not warrant the offerings of any businesses or individuals or the content of their websites. We do not assume any responsibility or liability for the actions, products, services, and content of any other third parties. You should carefully review the legal statements and other conditions of use of any website which you access through a link from this Platform. Your usage or access to any other off-site websites is at your own and sole risk. We will have no liability with respect to the acts, omissions, errors, representations, warranties, breaches or negligence of any such third parties or for any personal injuries, death, property damage, or other damages or expenses resulting from your interactions with the third parties under any circumstance whatsoever.

a) Acko General reserves the right to monitor the Platform, your account and all its content, and to disclose any information as necessary to satisfy any law, regulation or governmental request whether by the IRDAI, RBI, or any other law / authority, or to edit, remove any information or materials, in whole or in part, that in Acko General's sole discretion are objectionable or in violation of these Terms of Use, with or without prior notice to you. 

b) You can review the most current version of the Terms of Use at any time on this page. We reserve the right, at our sole discretion, to update, change or replace any part of this Terms of Use by posting updates and changes to this page. It is your responsibility to check our Platform periodically for changes. Your continued use of or access to our Platform or the Service following the posting of any changes to these Terms of Use constitutes unconditional acceptance of the said changes.

c) The Company reserves the right, at its sole discretion, to modify or replace, in part or full, any of these Terms of Use, or change, suspend, block, discontinue or restrict your use to all or any feature of the Service or Application at any time.

d) ACKO GENERAL MAY TRANSFER OR ASSIGN ITS RIGHTS AND OBLIGATIONS UNDER THESE TERMS OF USE TO ANY AFFILIATE OR ANY THIRD PARTY TO THE EXTENT PERMITTED BY ANY APPLICABLE LAWS, WITH OR WITHOUT NOTICE TO YOU.

For accessing or using this Platform or Services, the Privacy Policy as set forth on the Platform - “www.acko.com/gi/privacy-policy/” shall be applicable to any personal data. By using this Platform and /or Service or any part thereof, you signify your acceptance of the Privacy Policy displayed on the Platform. If you disagree with the contents of the Privacy Policy, Acko General or its affiliates may not be able to extend the Platform and/or the Services to you.

Notices under these Terms of Use may be given by Acko General to the Customer in writing over email on the registered email ID provided to the Company at the time of creation of your account or thereafter or any other means as it deems fit. We may give notice by  it or through its affiliates or partners by delivering them to the home or other address provided by you on the Platform, stored in your account or otherwise provided to us or our affiliates while availing any services. Unless otherwise prohibited by any applicable laws, Acko General shall be deemed to have fulfilled any legal obligation to deliver to the Customer if any such document is sent via electronic email. 

Acko General or its affiliates may also publish notices of general nature, which are applicable to all Visitors or Customers in a newspaper or on its Platform or any other online channel. Such notices will have the same effect as a notice served individually to each Visitor or Customer or upon posting.

You authorize Acko General and/or its affiliates or partners to call, send SMS, messages via WhatsApp or any other electronic application means, and email on the contact number and email ID (made available by you on our Platform or otherwise voluntarily provided by you) and offer you information and services for the product you have opted for. You authorize us to call, send SMS, message via electronic means or email you for the purpose mentioned under these Terms of Use, irrespective of whether you are registered with the NDNC registry. You also agree that Acko General reserves the right to make your details available to its affiliates and partners, and you may be contacted by the affiliates and/or partners for information and for sales through email, telephone and/or SMS or other modes of communication. You agree to receive promotional materials and/or special offers from us, our affiliates and our partners through email, phone, SMS or other forms of messaging and/or calling services.

The invalidity of any term of these Terms of Use shall not affect the validity of the other provisions of these Terms of Use. Our failure to exercise any remedy or enforce any portion of these Terms of Use at any time shall not operate as a waiver of any remedy or of the right to enforce any portion of the Terms of Use at any time thereafter.

All disputes arising from or related to these Terms of Use shall be subject to the exclusive jurisdiction of the courts at Bangalore. The Terms of Use are subject to the laws of India.

Acko General has provided the relevant information in relation to the policies/products in the policy documents. Accordingly, please read the policy wording carefully before concluding a sale.
